“我在对被诉主体注册地址进行现场核查时没找到这家蛋糕店，在对店铺上传的证照进行核实后，判断是假证。”负责现场检查的该所四级主任科员马浩林说。进一步调查显示，“甜颜情书”名下378家连锁店的食品经营许可证全部伪造，无任何线下实体。

执法人员通过下单追踪发现，订单被一键转发至“转单宝”平台，由出价最低的商家接单制作。以一款252.4元的蛋糕为例，“幽灵店铺”收取122元，平台服务费50.4元，实际制作方扣除转单宝服务费3.2元后仅得76.8元，还需承担快递费。

《网络餐饮服务食品安全监督管理办法》明确禁止入网餐饮服务提供者将订单委托其他经营者加工。中国人民大学食品安全治理协同创新中心研究员孙娟娟指出，转单式“幽灵外卖”是更隐蔽、更具危害性的违法乱象。

2025年8月，市场监管总局接到北京市局紧急报告后，抽调全国执法人员成立专案组。对“转单宝”和安徽寻梦平台突击检查发现，转单蛋糕订单超过360万个，涉及7家头部电商平台，查实“幽灵店铺”67604家。调查中，部分平台以“系统升级”“商业秘密”为由拖延配合，个别平台甚至出现暴力抗法，南京一名执法人员因平台员工故意关门导致左手食指骨折。

市场监管总局执法稽查局稽查四处处长韩冰介绍，过去对平台未履行审查义务的处罚，按一个违法行为顶格20万元，违法成本低。此次采取“一店一处罚”，即对平台未审查的每一家“幽灵店铺”分别认定违法，罚没总额达35.97亿元。北京大学电子商务法研究中心主任薛军表示，法律适用应考虑执法目的与食品安全底线，不能机械。中国人民大学法学院院长杨东指出，此案是平台流量竞争的典型案例，需警惕流量垄断，推动平台经济公平可持续发展。

截至发稿，7家平台已下架相关“幽灵店铺”，停止与转单平台的餐饮转单合作。
